Display

​

I reserve the right to display your book cover in my own portfolio and professional pages.

​

PAYMENT & RIGHTS

 

Deposit 

​

A deposit of 50% is required at the start of the agreement and it's non-negotiable. The rest of the payment will be transferred after the final approval of the book cover. Once the final payment is approved, you will receive your book cover in the format of your choice ( JPG or PNG ) for the ebook or in PDF format for a print-ready book cover.

Payment Method

​

The only payment method accepted is by Paypal, I accept all currencies but be aware that there is an exchange rate so the price may vary depending on that.

​

Final Payment

​

Final payment is due within 7 days of the invoice being sent.  A 5% late fee will be added for each additional week that payment has not be received.  Invoices not paid within 90 days will have a $100 fee applied.  No files will be released until final payment has been made.

Pricing

​

Prices are subject to change at any time and without warning.  Price is guaranteed upon agreement of the terms & conditions and deposit has been received.  Future series installments may be grandfathered in at previous prices at the sole discretion of Makerva Digital Art.

Refunds

​

You can get a refund if and only if I haven't started your custom book cover design yet, once I've started there will be no refunds.

​

For the premade covers all sales are final and will not be refunded under any circumstances.

Proofing

​

Client must test and try proofing of printing. At no time will Makerva Digital Art be held financially or legally responsible for any problems, costs, fees, or expenses incurred by client as a result of using the art and/or book cover design.

Ownership Rights

​

Upon receipt of full payment, Makerva Digital Art grants the client the exclusive license to use the final cover design artwork for his/her book cover and associated promotional materials (Banners, Ads, Bookmarks & teasers).  Makerva Digital Art maintains full copyright of all designs and draft concepts (including layout, style, image placement and fonts) and may not be recreated by anyone, nor can any works be based on the original design at the sole exception where the Artist cannot be reached (ie: Makerva Digital Art no longer exist) or cannot continue the series in which case the Client must have the Artist written permission to continue the series with another designer.  

 

Artwork and design may not be reused, or used out of context.

The client understands that he/she has no right to use any designs created by Makerva Digital Art, in whole, part, or as part of a derivative work, to create or sell non-fungible tokens (NFTs) of any kind.

Unaltered, finished book cover design may be used/included on promotional merchandise, provided the usage is in accordance with the rights and limitations of the licensing agreement of the stock image provider(s).

The client understands that he/she has no right to alter the final cover design in any way except to change size for printing or digital display. If the client desires any alterations, he/she must consult Makerva Digital Art. The client understands that additional payments may be required to make these alterations.

The client agrees to abide by the terms of any license agreement for any images purchased by Makerva Digital Art through a third-party image provider for use in client’s book cover design. The cost of cover design includes the standard license to use these images in the design and is limited to a print run of 500,000 units for Depositphotos. For books with a print run over these limits, additional licensing fees may apply.

 

Makerva Digital Art always retains the right to use the final design, author name and book title in their portfolio and to market and promote services.

 

Raw layered files (PSD files) will not be provided to client due to copyright issues. PDF, JPG and PNG files will be provided. 

 

Upon request, Makerva Digital Art can provide the flattened blank artwork (without texts) and flattened title to the client for marketing purposes only.

 

The client understand that the purchase constitute an agreement to abide by the terms of the standard license from the third-party stock provider who supplied the stock images used in the cover. Receiving the blank artwork will incur an extra fee and does not constitute a transfer of copyrights.

Reselling

​

The written permission of Makerva Digital Art is needed in order to resell a previous purchased design to another author. There are no transactions possible without this written permission.

​

Resale of select covers to other authors is allowed by only with prior written permission from Makerva Digital Art. Retitling and changes will incur extra fees.

 

Liability

​

At no time will Makerva Digital Art be held financially or legally responsible for any problems, costs, fees or expenses incurred by Client as a result of using the book cover design provided by Makerva Digital Art.  While Makerva Digital Art will do their best to fix any problems that may arise with the book cover design, they cannot be held responsible for any costs, fees, or expenses due to any problem with the book cover design.

Publishing Rights

​

Client represents and warrants that the text, graphics, photographs and/or other material provided by Client for the book cover design project are owned or licensed by Client and that Client is authorized to use and display such items in a book cover design.  Client shall be solely responsible for the materials and the validity of copyrights, trademarks and ownership claimed by Client.  Client agrees to indemnify and hold the Artist harmless from and against any claim of infringement, or any trademark, copyright or trade secret, or negligence arising from any of the text, graphics, photographs or other material provided by Client. Makerva Digital Art reserves the right to request a copy of secured rights.

Client agrees to abide by the terms of any license agreement for any images purchased by Makerva Digital Art through any third-party provided for use in final design.

Investigation of Rights

​

Unless expressly agreed, Makerva Digital Art assignment does not include conducting research into the existence of trademark rights, drawing or design protection, patent rights, copyrights, and portrait rights of third parties. The same applies to research into the possibility of such forms of protection for the client.
